How can you justifiably dismiss team members?

Team members who

  • fail to perform through incompetence or laziness
  • fail to improve unsatisfactory behaviour – see disciplinary action
  • are guilty of gross professional misconduct
  • are guilty of criminal acts

are dismissed after all other alternatives have been explored and you are able to:

  • demonstrate good faith and professionalism,
  • respect for organisational policies and procedures, the provisions of the contract, and labour laws,
  • provide proof and justification for your actions.

Expensive and time consuming appeals and court cases which overturn any dismissal even where the grounds for dismissal were sound.

Unfair but successful dismissal which leaves the team member with severe financial problems and a loss of self-respect and worth.
